  1. No-Nonsense License Statement and Limited Warranty
  2.  
  3. This software is protected by both United States copyright law
  4. and international treaty provisions.  You must treat this
  5. software just like a book, except that you may copy it onto a
  6. computer to be used and you may make archival copies of the
  7. software for the sole purpose of backing up our software and
  8. protecting your investment from loss.
  9.  
  10. By saying "just like a book," Borland means, for example, that
  11. this software may be used by any number of people, and may be
  12. freely moved from one computer location to another, so long as
  13. there is no possibility of it being used at one location or  on
  14. one computer while it is being used at another.  Just like a book
  15. cannot be read by two different people in two different places at
  16. the same time, neither can the software be used by two different
  17. people in two different places at the same time (unless, of
  18. course, Borland's copyright is being violated).

  20. DEMO SOFTWARE
  21.  
  22. The software is a "demo" release of a Borland development product.  The
  23. software and programs that you compile using the software (i.e., contain
  24. any portion of Borland code) are for your own personal use.  Should you
  25. desire to distribute compiled programs to others, you will need to first
  26. upgrade to a regular release of the Borland development product.  You are
  27. of course not restricted from distributing source code which is entirely
  28. yours.

  30. You shall remain solely responsible for, and will hold Borland harmless from,
  31. all claims, liability and damages arising from your own programs which
  32. include any of the Borland code.
  33.  
  34. LIMITED WARRANTY 
  35.  
  36. Borland warrants the physical diskette(s) and physical documentation
  37. enclosed herein to be free of defect in materials and workmanship for a
  38. period of sixty days from the purchase date.  If Borland receives notification
  39. within the warranty period of defects in materials or workmanship, and such
  40. notification is determined by Borland to be correct, Borland will replace the
  41. defective diskette(s) or documentation.

  43. The entire and exclusive liability and remedy for breach of this
  44. Limited Warranty shall be limited to replacement of defective
  45. diskette(s) or documentation and shall not include or extend to
  46. any claim for or right to recover any other damages, including by
  47. not limited to, loss of profit, data or use of the software, or
  48. special, incidental or consequential damages or other similar
  49. claims, even if Borland has been specifically advised of the
  50. possibility of such damages.  In no event will Borland'sliability for any
  51. damages to you or any other person ever exceed
  52. the lower of suggested list price or actually price paid for the
  53. license to use the software, regardless of any form of the claim.

  55. BORLAND INTERNATIONAL INC. SPECIFICALLY DISCLAIMS ALL
  56. OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT
  57. LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR
  58. FITNESS FOR A PARTICULAR PURPOSE.  Specifically, Borland makes no
  59. representation or warranty that the software is fit for any particular
  60. purpose and any implied warranty of merchantability is limited to the
  61. sixty-day duration of the Limited Warranty covering the physical
  62. diskette(s) and physical documentation only (and not the
  63. software) and is otherwise expressly and specifically disclaimed.

  65. This limited warranty gives you specific legal right; you may
  66. have others which may vary from state to state.  Some states do
  67. not allow the exclusion of incidental or consequential damages,
  68. or the limitation on how long an implied warranty lasts, so some
  69. of the above may not apply to you.

  71. GOVERNING LAW AND GENERAL PROVISIONS

  73. This license Statement and Limited Warranty shall be construed,
  74. interpreted and governed by the laws of the State of California
  75. and any action hereunder shall be brought only in California.  If
  76. nay provision is found void, invalid or unenforceable it will not
  77. affect the validity of the balance of this License and Limited
  78. Warranty which shall remain valid and enforceable according to
  79. its terms.  If any remedy hereunder is determined to have failed
  80. of its essential purpose, all limitations of liability and
  81. exclusion of damages wet forth herein shall remain in full force
  82. and effect.  This License and Limited Warranty may only be
  83. modified in writing signed by you and a specifically authorized
  84. representative of Borland.  Use, duplication or disclosure by the
  85. U.S. Government of the computer software and documentation in
  86. this package shall be subject to the restricted right under DFARS
  87. 52.227-7013 applicable to commercial computer software.  All
  88. rights not specifically granted in this statement are reserved by
  89. Borland.
